Terms of Service and End User License Agreement (EULA)

By downloading, installing, or using the Imago application ("App"), you agree to these Terms of Service and End User License Agreement (EULA). If you do not agree, do not use the app.

1. Definitions

  • "App": Imago mobile application
  • "We/Our": Alihan Kayhan
  • "User/You": The person who downloads and uses the App
  • "Premium": In-app credit purchase
  • "Content": Templates, AI-generated photos, design assets, and other materials within the App

2. License Grant

We grant you a limited, revocable, non-exclusive, and non-transferable license under the following conditions:

  • You may use the App for personal, non-commercial purposes
  • You may only use the App on devices you own
  • If you purchased Premium, you can access all features

3. Account Creation and Security

  • You need to create an account to fully use the App
  • You agree to provide accurate and current information during registration
  • You are fully responsible for account security
  • You cannot share your account with others
  • You must immediately notify us if you notice unauthorized access to your account

4. Age Requirements

To use the App:

  • You must be older than 13 years
  • If you are between 13-18, you can use it with parental or legal guardian permission

5. Fees and Purchases

5.1 Free Version

  • Basic features of the App are offered for free
  • Some features and content are limited

5.2 Premium Purchase (One-Time Payment)

  • Premium is a one-time purchase (not a subscription)
  • When you purchase Premium, you get permanent access to all features
  • Prices are shown on App Store or Google Play and may be in local currency

5.3 Refund Policy

⚠️ Important: Our refund policy for digital content sales is as follows:

  • iOS (App Store): Refund requests must be made directly to Apple. Apple's refund policy applies. To request a refund: reportaproblem.apple.com
  • Android (Google Play): You can request a refund through Google Play within 48 hours of purchase. For after 48 hours, contact us.
  • If you experience technical issues, we recommend contacting our support team first

6. Prohibited Uses

The following actions are strictly prohibited:

  • Copying, modifying, or creating derivative works of the App
  • Reverse engineering the App or attempting to extract source code
  • Distributing, selling, or sharing content without permission
  • Using the App for illegal purposes
  • Creating fake accounts
  • Taking actions that would disrupt the normal operation of the App
  • Attempting to bypass security systems
  • Harming other users

7. Intellectual Property Rights

  • The App and all its content (templates, design assets, code, graphics) are protected by copyright
  • All intellectual property rights belong to us
  • These terms do not transfer any intellectual property rights to you
  • You cannot use our trademarks without permission

8. Photo Uploads, Face Data, and AI Processing

By uploading photos to the App, you acknowledge and agree to the following:

  • Face Data Processing: Your uploaded photos, which may contain face data, will be processed by third-party AI services (Google Cloud Vision API for face validation, and Fal.ai for AI photo generation and enhancement) as described in our Privacy Policy
  • Your Photos: You retain ownership of the original photos you upload. You grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the AI enhancement service
  • AI-Generated Results: AI-generated photos are created for your personal use. The AI results are based on your uploaded photos but are generated by third-party AI technology
  • Temporary Storage: Your original uploaded photos are stored for 30 days to enable before-and-after comparison, after which they are automatically and permanently deleted
  • Prohibited Content: You must not upload photos containing illegal content, photos of minors without parental consent, or photos of other individuals without their permission
  • No Guarantee: We do not guarantee that AI-generated results will be accurate, flattering, or suitable for any particular purpose

9. Limitation of Liability

The App is provided "AS IS" and "AS AVAILABLE". We do not guarantee:

  • That the service will operate without interruption or errors
  • That AI-generated results will meet your expectations or be suitable for any particular purpose
  • That you will achieve specific results

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses arising from your use of the App in violation of these terms.

11. Account Suspension or Termination

We may suspend or terminate your account without prior notice in the following situations:

  • Violation of these terms of service
  • Fraud or abuse
  • Legal obligations
  • Long-term (12+ months) inactive accounts

12. Changes

We reserve the right to update these terms at any time:

  • In-app notification will be sent for important changes
  • Continuing to use the app after changes are published means you accept the new terms
  • If you do not agree with the changes, you should stop using the app and delete your account

13. Applicable Law and Dispute Resolution

  • This agreement is subject to the laws of the Republic of Turkey
  • Turkish courts have jurisdiction over disputes
  • Amicable resolution will be sought before litigation

14. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
